1About these terms
These terms are an agreement between you (the business using TradieChat) and Mark Davis trading as TradieChat (ABN 12 055 294 011), Bunbury, Western Australia. "We", "us" and "our" mean TradieChat.
You accept these terms when you enter your payment details to start your pilot. Our Privacy Policy explains how we handle personal information.
TradieChat is a service for businesses. It isn't designed for personal or household use.
2What TradieChat does
We build and run an enquiry assistant for your business. It includes:
- your own TradieChat page (for example, tradiechat.au/your-business) that answers common customer questions using the information you give us
- an enquiry form that sends new leads to you by SMS and/or email
- content updates as described in section 8.
3Getting started and your free pilot
- You fill in our intake form. No card is needed.
- We build and test your page, usually within 2 business days, and send you a preview.
- You reply to approve it, and we send you a secure payment link.
- When you enter your card details, your page goes live and your free 14-day pilot starts.
Stripe emails you a reminder 7 days before your pilot ends. We'll also email you before the first charge. If you cancel before day 14, you pay nothing.
4Pricing and billing
| Plan | Setup | Monthly |
|---|---|---|
| Standard | A$199 (one-off) | A$69 |
| Founding member (first 3 clients only) | A$0 | A$49 |
- First charge: on day 14 of your pilot. For the standard plan that's A$268 (setup plus your first month). For founding members it's A$49.
- After that: your monthly fee is charged automatically each month.
- GST: we're not registered for GST, so no GST is charged.
- Founding member rate: locked at A$49 a month for as long as your subscription stays continuously active. It can't be transferred. If you cancel and rejoin later, standard pricing applies.
All prices are in Australian dollars. Payments are handled securely by Stripe.
5Cancelling and refunds
- During your pilot: cancel before day 14 and you're not charged anything.
- After your pilot: cancel any time, through your Stripe customer portal or by emailing us. Your page stays live until the end of the month you've paid for, then it's switched off.
- No part-month refunds. We don't refund the unused part of a month.
- Setup fee: once charged, the A$199 setup fee isn't refundable. By then, the build is done and you've had 14 days to try it free.
Nothing in these terms takes away rights you have under the Australian Consumer Law (see section 14).
6Failed payments
If a payment fails, Stripe will retry it automatically and let you know how to update your card. If it's still unpaid after 14 days, we'll pause your page and contact you. If we can't sort it out, we'll cancel your subscription and let you know by email.
7Price changes
We may change our prices in the future. If we do:
- we'll give you at least 30 days' written notice
- you can cancel free of charge before the new price starts
- founding member rates never change while the subscription stays continuously active.
8Content updates
- You can request up to 2 content updates a month. One request can include several changes.
- Extra requests can wait until the next month, or we can do them sooner for A$29 each if they're urgent.
- These are always free: fixing our mistakes, fixing phone numbers, and anything related to safety.
9SMS alerts and fair use
- Your plan includes up to 100 SMS lead alerts a month. Each mobile number that receives an alert counts.
- If you go over, standard leads are sent by email only for the rest of that month.
- Urgent leads are always sent by SMS, with no limit.
SMS and email delivery rely on phone networks and other providers. We can't guarantee every message arrives instantly, so please check your email as well as your phone.
10Your responsibilities
- Accurate information. Your page answers customers using the information you give us. Please make sure it's accurate, including prices, service areas and licence details, and tell us promptly when anything changes.
- Licences and claims. You're responsible for holding the licences your work requires and for any claims about your business shown on your page.
- Following up leads. You decide which jobs to take on and how to respond to customers.
- Customer details. Use customer details only to respond to their enquiry and do the job. If you want to contact them for anything else, such as marketing, follow the law, including the Spam Act.
You own your business content. You give us permission to use it to build and run your TradieChat page.
11Safety information
The assistant gives general information based on what you've approved. It isn't a tradesperson and can't inspect a problem. It doesn't replace your professional advice.
In an emergency, customers are directed to get urgent help. If there's danger to life or property, call 000. For gas leaks, call ATCO Gas on 13 13 52. For electrical hazards or fallen power lines, call Western Power on 13 13 51.
We build safety answers carefully and always fix safety-related content free of charge.
12Your leads and your data
- Your leads are yours. If you cancel, you can ask for a copy of your leads within 30 days of cancelling. We'll send it only to the email address on your account.
- We delete your data and your leads within 90 days of cancelling, from every place we keep it. Payment records are kept for 5 years for tax.
- We use de-identified usage information to improve TradieChat for everyone. We never sell data, and we never show your leads or statistics to another tradie.
- Testimonials: we only show your testimonial or business name on our website with your written OK. You can withdraw it any time and we'll remove it within 7 days.
13Who owns what
- We own TradieChat. That includes the software, design, answer logic and page templates, and any improvements we make to them.
- You own your business content. Your business name, logo, prices and wording stay yours.
- While you're subscribed, you can use your TradieChat page for your business. You can't copy, resell or rebuild TradieChat, or let anyone else do so.
- When your subscription ends, your page comes down. Your content is still yours.
14Our responsibility to you
We work hard to keep TradieChat reliable. If we get something wrong, we'll fix it as quickly as we can.
Your consumer law rights
You may have rights under the Australian Consumer Law that can't be excluded. Nothing in these terms removes them.
Limits on our liability
As far as the law allows:
- if our service fails, our responsibility is limited to supplying the service again, or paying the cost of having it supplied again
- our total liability to you is limited to the fees you've paid us in the 12 months before the claim
- we're not responsible for lost profits, lost jobs or other indirect losses. For example, a missed enquiry isn't a guaranteed job.
These limits don't apply where the law doesn't allow them to, including for fraud.
Service availability
TradieChat relies on other providers, such as hosting, Google and phone networks. There may occasionally be interruptions we can't control. We'll let you know about any significant problem and fix it as fast as we can.
15Pausing or ending the service
We may pause or end your service if payment stays overdue (see section 6), or if TradieChat is used for anything unlawful, misleading or abusive. Where it's reasonable, we'll contact you first so you can fix the problem.
If we ever stop offering TradieChat, we'll give you at least 30 days' notice.
16Changes to these terms
We may update these terms and will change the date at the top. If a change would disadvantage you, we'll give you at least 30 days' notice by email, and you can cancel free before it takes effect.
17Disputes
If you have a problem, please contact us first. Most things can be sorted with a quick conversation. These terms are governed by the law of Western Australia.
